The Landmark Biometric Processing Privacy Code 2025: What You Need to Know

A pivotal development in New Zealand's privacy framework is the Biometric Processing Privacy Code 2025, issued by the Office of the Privacy Commissioner and effective from November 3, 2025 for new processing, and August 3, 2026 for existing systems. This Code introduces specific, mandatory privacy rules for any organisation that collects and uses individuals' biometric information through "biometric processing," which includes technologies like facial recognition used for identification or to infer details about people.

The Code directly addresses a range of critical privacy risks inherent in biometric technologies, such as:

  • Over-collection or over-retention of sensitive biometric data.
  • Inaccuracy or security vulnerabilities affecting biometric information.
  • A lack of transparency about how biometric data is processed.
  • Misidentification or misclassification of individuals, especially when based on attributes like race, ethnicity, gender, age, or disability, which can introduce bias.
  • The potential for surveillance, monitoring, or profiling to result in "adverse actions" or a "chilling effect," deterring individuals from exercising their protected rights.
  • "Scope creep," where collected information is used for expanded purposes without individuals' knowledge or authorisation.
  • A diminished ability for individuals to avoid monitoring in spaces where they reasonably expect not to be observed.

Crucially, the Code places significant limits on "biometric categorisation"—automated processes that analyse biometric information to infer health information, personal characteristics (like personality, mood, or mental state), or to assign individuals to demographic categories (e.g., sex, age, ethnicity, sexual orientation). Such categorisation is generally prohibited unless specific, limited conditions are met, such as assisting with accessibility, preventing serious threats to public health or safety, or for ethically approved statistical or research purposes.

Organisations must adhere to comprehensive safeguards, including clear rules on the purpose and manner of collecting biometric information, its storage and security, individuals' rights to access and correct their data, retention limits, and strict controls on its use and disclosure, including cross-border transfers. Compliance demands a deep understanding of these rules, as the Privacy Commissioner is mandated to review the Code by November 2028, ensuring its continued relevance.

AI Strategy and Broader Privacy Reforms

The Biometric Code is part of a larger strategic effort. New Zealand launched its first national Artificial Intelligence (AI) strategy on July 17, 2025, which underscores principles for responsible AI use and reinforces commitments to privacy and data protection. This strategy aims to build public trust in digital systems and sets clear expectations for AI use across all sectors, acknowledging the substantial economic potential of AI while balancing it with the need for accountability. The Ministry of Business, Innovation and Employment (MBIE) has also released a "Responsible AI Guidance for Businesses toolkit" to aid organisations in adopting AI responsibly.

Breaches of CPDA data storage and security requirements are considered breaches of the Privacy Act and are investigable by the Privacy Commissioner.

The Privacy Commissioner continues to advocate for "data minimisation"—collecting only necessary information—as a critical component of privacy protection. Less data collected means less data that can be potentially stolen by cybercriminals.

Robust privacy regulations are intrinsically linked to effective cybersecurity. While New Zealanders are becoming more confident in their ability to navigate cyber security (71% in December 2024), this confidence doesn't always translate into consistent protective actions or increased reporting of incidents.

The cyber threat landscape is increasingly sophisticated, with cybercriminals leveraging AI and cryptocurrency to make attacks more disguised and untraceable. New Zealand suffered an estimated $1.6 billion in financial losses from online threats in 2024, with $7.8 million lost in the first quarter of 2025 alone, and over half of reported losses affecting businesses. Common threats include scams and fraud, phishing, and ransomware, which can devastate businesses through data encryption, theft (double and triple extortion), and operational disruption.

Unfortunately, nearly half (44%) of people who experience cyber attacks do not report them, often due to apathy or a belief that reporting won't make a difference. This underreporting hinders a comprehensive understanding of the threat environment and effective response.

By implementing strong privacy safeguards, especially for sensitive data like biometrics, organisations inherently bolster their cybersecurity posture. Data minimisation reduces the attack surface, and clear rules for data handling reduce vulnerabilities to breaches and misuse. The Biometric Processing Privacy Code 2025 acts as a foundational defense, mandating security measures that make it harder for cybercriminals to exploit this highly sensitive personal information.

The message is clear: businesses must be proactive and intentional about privacy. Two-thirds of New Zealanders would consider changing service providers due to poor privacy practices, highlighting the commercial imperative of robust compliance.
